- No lot shall be
used except for residential purposes and shall
not be subdivided.
- No dwelling
shall be placed upon said land except for a
single family residence, not to exceed three (3)
stories in height and with a minimum of one
thousand (1000) square feet exclusive of
porches, garages, carports, patios and other
similar exterior open additions.
- No building
shall be erected on any lot nearer than 25ft.
from any boundary line of said lot with the
exception of bluff front lots, where houses may
be built on the boundary line closet to the
bluff.
- Any and all
buildings started on any lot shall be completed
within nine (9) months from the time
construction is started.
- Trailers, mobile
homes and motor homes used as a permanent
residence will not be permitted on any lot. No
structure shall be built or moved on to any lot
unless it conforms to and is in harmony with
existing structures on the property.
- No illegal,
noxious or offensive use shall be made or
carried on upon any lot, nor shall anything be
done thereon which may be or become a nuisance
to the neighborhood. No lot owner will be
permitted to store old or wrecked cars, trucks,
road machinery, crates, barrels, boxes, scrap
metal or unsightly junk of any kind on any lot.
- No swine or
other farm animals, except horses, shall be
allowed or permitted to be maintained on any lot
at any time. Domestic animals, such as dogs,
cats and household pets and horses will be
permitted, with the number of said animals
subject to review by the land developers. Owners
shall not use said property for professional
breeding or boarding. Owners will be asked to
remove any animal that becomes a threat or
nuisance to other property owners.
- No illegal,
noxious, or offensive noises shall be made or
carried on upon any lot, nor shall anything be
done thereon which may be or become a nuisance
to the neighborhood.
- These Deed
Restrictions are to run with the land and shall
be binding upon and obligatory upon all persons
who now own property or who may own , possess or
occupy any of said property hereafter. Upon
completion of Sunset Bluff restrictions may be
altered or deleted by a 51% majority written
vote of all property owners.
- Enforcement of
Deed Restrictions shall be by proceedings at law
or in equity against any person or persons
violating or attempting to violate any
restriction, either to restrain violation or to
recover damages. All costs of enforcement
including attorney's fees shall be borne by the
owner and/ or party violating or attempting to
violate any restriction.
